نامه حسین خضری، زندانی محکوم به اعدام



مدت ۴۹ روز تحت شکنجه بودم ازقبیل ضربه زدن با لگد به اندام های تناسلی و خونریزی و تورم آن نواحی از بدنم به مدت چهارده روز
حسین خضری زندانی سیاسی محکوم به اعدام، طی نامه ای به افکار عمومی و سازمان های و نهاد های حقوق بشری، خواهان پیگیری طرح شکایت خود از دستگاه اطلاعاتی، سپاه پاسداران و دستگاه قضایی شده است.
به گزارش ارگان خبری فعالان حقوق بشر در ایران، وی در بخشی از نامه خود می گوید به مدت ۴٩ روز در سلول های انفرادی سپاه و در بازداشتگاهی مخفی که زیر نظر سازمان زندان های نیست به شدت شکنجه و وادار به اعتراف شده است.
متن این نامه به شرح زیر است

اینجانب زندانی سیاسی حسین خضری که به اتهام اقدام علیه امنیت ملی از سوی شعبه اول دادگاه انقلاب اسلامی ارومیه و همچنین تایید شعبه ده دادگاه تجدید نظر آذرباییجان غربی و همچنین تایید حکم صادره از سوی شعبه ٣۱ دیوان عالی کشور به اعدام محکوم شده ام.

برای پرده برداشتن از نحوه بازجویی، بازپرسی و دادگاهی که شدیدا از انعکاس و نحوه چگونگی مراحل ذکر شده به افکار عمومی و بیدار جامعه مدنی داخل و خارج جلوگیری به عمل آمده و می آیدو حتی از نامه سرگشاده ای که به عنوان اعتراض قانونی به مراحل پرونده سازی به ریاست قوه قضاییه کشور نوشته بودم مسئولین زندان از تایید آن امتناع می کنند.
با وجود تمامی این مشکلات بنده شرح مختصری از وضعیتی که به بنده وارد شده و به نوعی تا به حال ادامه دارد میدهم باشد که گوشی شنوا شنیده و زبانی حق گو شروع به بازگو و ارسال مطالب زیر نماید.
اینجانب در تاریخ دهم مرداد ماه ٨٧ در شهرستان کرمانشاه توسط نیروهای سپاه نبی اکرم آن شهرستان دستگیرشدم و مدت ۴٩ روز که در اختیار نیروهای سپاه نبی اکرم کرمانشاه بودم ومتحمل شکنجه های فیزیکی و روحی در زمان بازجویی بودم که شکنجه ها از نظر فیزیکی شامل :
۱- کتک زدن به مدت چندین ساعت در هر روز
٢- ایجاد فشار روحی و روانی در حین بازجویی
٣- تهدید بازجویی هایم مبنی بر آنکه اگر آن مواردی که ما میگوییم قبول نکنی به برادر و داماد خانواده شما میتوانیم برچسب فعالیت های غیرقانونی علیه نظام بزنیم
۴- ضربه زدن با لگد به اندام های تناسلی من و خونریزی و تورم آن نواحی از بدنم به مدت چهارده روز
۵- پارگی پای راستم تقریبا به اندازه ٨ سانتیمتر به علت ضربه محکم پای بازجو که هنوز قابل مشاهده است
۶- وارد کردن ضربات متعدد به تمامی بدنم با باتوم این موارد در مدت ۴٩ روز بازداشت بنده در بازداشتگاه سپاه پاسداران کرمانشاه بود.
حال سوالی که مطرح می گردد این است که مگر در قانون اساسی جمهوری اسلامی ایران در اصل ٣٨ آن صراحتا بیان نشده است هرگونه شکنجه برای گرفتن اقرار و یا کسب اطلاع‌ممنوع است‌، اجبار شخص به شهادت‌، اقرار یا سوگند مجاز نیست‌و چنین شهادت و اقرار و سوگندی فاقد ارزش و اعتبار است‌ و متخلفین از این اصل مجازات می شوند.
در حالی که به آن صورتی که ذکر کردم بنده در مدت بازداشت در سپاه نبی اکرم کرمانشاه هم متحمل شکنجه فیزیکی شده ام هم شکنجه روحی و روانی .پس چطور اقرارهای بنده که به زور شکنجه از من گرفته اند دلیل و مدرک معتبری برای دادگاه شده و بنده را به چنین حکم سنگینی یعنی اعدام محکوم کرده اند.
بعد از آن در مورخ ٢٨ شهریور ٨٧ بنده را از سپاه نبی اکرم کرمانشاه به سپاه المهدی ارومیه منتقل کردند و در آنجا نیز تحت انواع شدیدترین شکنجه های فیزیکی و روحی قرار گرفتم .
دوباره مورخ ۱۶ دی از بازداشتگاه سپاه المهدی شهرستان ارومیه به اداره کل اطلاعات اذرباییجان غربی منتقل شدم و تا تاریخ ٢۶ بهمن همان سال تحت اختیار اداره اطلاعات ارومیه بودم و تمامی موارد شکنجه در طی بازداشتم در اداره اطلاعات ارومیه اجراو اعمال شد.
بعد از آنکه بنده را به زندان ارومیه منتقل کردند در تاریخ ٢۱ اردیبهشت ٨٨ برای اولین بار و آخرین بار بنده را در شعبه یک دادگاه انقلاب اسلامی ارومیه دادگاهی نمودند که در جلسه دادگاه نماینده اداره اطلاعات ارومیه و دادستان حضور داشتند و قبل از آن هم اینجانب را ماموران اداره اطلاعات ارومیه تهدید کردند که نه از شکنجه باید حرفی بزنی و نه در مورد بازجویی های که از تو گرفته ایم البته به زور شکنجه! بالاخره با این جو سازی در دادگاه بدوی و همچنین با عدم اعطای زمان کافی برای بنده برای دفاع از خودم و جمع جور کردن محاکمه بنده در حدود ده دقیقه و اتمام آن کاملا جای سوال برای بنده شد که آیا در عرض ده دقیقه و با آن اتمسفر حاکم بر فضای دادگاه چطوری من و وکیلم میتوانستیم از اتهامات وارده دفاع نماییم و چگونه از این اتهام سنگین برائت کنیم.
سوال دیگری که برای من متصور می شود این است که آیا حضور من در جلسه ای دادگاه به منزله اجرای اجباری نمایشی درام و کمدی نبود که فقط آقایان گفته باشند که متهم در دادگاه حضور بهم رسانده و با توجه به طی مراحل دادگاهی محکوم شد .
سوال بعدی هم آن که در دادگاه به قاضی پرونده ام آقای درویشی، رییس شعبه یک بیان کردم که بسیاری از بازجویی های خود را قبول ندارم زیرا به زور شکنجه های فیزیکی و روانی مجبور به قبول آن مطالب گشته ام در حقیقت آنها را به من دیکته کرده و قبولانده اند، ولی با این همه قاضی پرونده هیچ اعتنایی به مطالبم ننمود توضیح آن که اعمال شکنجه از سوی بازجو هایم با توجه آنکه ایشان یعنی بازجویان مرا تهدید کرده بودند به قاضی گفتم ولی افسوس از گوش شنوا، متاسفانه قاضی بدون هیچگونه تحقیق و تفحصی در مورد ادعای شکنجه بنده مبادرت به صدور رای اعدام نمود و رای همان دادگاه بدوی توسط شعبه ده تجدید نظر استان آذرباییجان غربی در مورخ ۱٧ مرداد ٨٨ تایید شده و در تاریخ ۱۱ مرداد حکم قطعی صادر شده و در زندان مرکزی ارومیه به من ابلاغ گردید.
درضمن من تا قبل از قطعی شدن حکم دادگاه دست از تلاش بر نداشتم و در تاریخ ۵ مرداد از نوع رفتار غیرانسانی و غیرقانونی بازجو هایم به دادسرای نظامی شهرستان ارومیه شکایت کردم که مورخ ۱۰ بهمن ٨٨ ابلاغ گردیده است.
شکایتم از دادسرای نظامی به دادسرای عمومی رسید و همان موقع به برادرم در مورخ ٢٧ بهمن ٨٨ ابلاغ شده است به محض شکایت بنده از نحوه بازجویی و برخورد ماموران سپاه المهدی و اداره اطلاعات ارومیه در تاریخ ۱۶ آذر ٨٨ به بازپرسی شعبه هشتم احضار و وضعیت شکنجه و نحوه برخورد بازجویان را اعلام و همچنین مدارک پزشکی که دال بر شکنجه شدن اینجانب مینمود تقدیم کردم و در ضمن درخواست معرفی به پزشکی قانونی را نمودم و تعجب آور انکه بازپرس شعبه ٨ در برابر اظهارت بنده حتی نخواست برای اثبات راست یا دروغ بودن موارد ذکر شده، بنده را به پزشکی قانونی اعزام نماید.
در تاریخ ۱٣ بهمن ٨٨ یعنی درست بعد از آنکه بنده طرح شکایت نموده و در بازپرسی شعبه ٨ اظهارت خود را نوشته و مدارک پزشکی را تقدیم بازپرس نمودم و پرونده در دادسرای نظامی عدم صلاحیت خورده و به دادسرای عمومی رفته به عبارتی ۳ روز بعد از نامه نگاری اداره سازمان قضایی نیروهای مسلح استان آذربایجان غربی با دادسرای عمومی در خصوص عدم صلاحیت رسیدگی دادسرای نظامی ارومیه و ارجاع پرونده به دادسرای عمومی مرا به اداره اطلاعات ارومیه برده و در مدت ٣ روزی که در بازداشتگاه مرکزی اداره اطلاعات ارومیه بودم انواع و اقسام تهدید ها مبنی بر آنکه اولا چرا بر علیه ما در دادگاه طرح شکایت کردی ثانیا در برابر دوربین فیلم برداری حاضر به اعتراف نوشته های که ما به شما می دهیم باشید و متذکر گردید که هیچ نوع بد رفتاری و شکنجه نشده ما نیز در عوض نسبت در رای که برایت صادر شده تخفیفاتی را به وجود می آوریم.

در حقیقت آشکارا تهدید بنده و ایجاد فضای سوداگری و عامه گری انگار سرنوشت انسانها نیز مانند کالا قابل داد و ستد است در حالی که انتقال من از زندان ارومیه به اداره اطلاعات باعث ایجاد استرس و دلهوره شدید در بین اعضای خانواده ام شده و با توجه به انکه پدرم برای کسب اطلاع از وضع بنده به اداره اطلاعات ارومیه مراجعه و متاسفانه با شنیدن جواب های گنگ و مبهم تصور می کنند که شاید مرا اعدام کرده اند و ایشان همانجا جلوی درب اداره اطلاعات ارومیه دچار سکته مغزی شده و بعد از اعزام به بیمارستان دار فانی را وداع میگویند این نیز برگ دیگری از جنایات دستگاه امنیتی جمهوری اسلامی ایران که با ایجاد نگرانی برای خانواده ضربه مهلک هم به من هم به خانواده ام وارد کردند که از صدها اعدام کردن برایم بدتر بود حال چه کسی جوابگویی این مسائل است خدا می داند.
جالب آنکه بیست روز بعد از فوت پدرم نگذشته بود که آقایان عوض عرض تسلیت به بنده مرا بدون هیچگونه دلیلی و بدون هیچ اطلاعی به زندان قزوین تبعید کردند حال تصور کنید که من در چه حالت روحی قرار گرفته بودم و مهم تر از همه آنکه بعد از چند ساعت که به طور چشم بسته و پا بسته و دست بسته به من گفتند که چیز خاصی نیست و تو را به زندان دیگری انتقال میدهیم .
در مورخ ٣۰ فروردین قرار منع تعقیب در شعبه ۱۰۴ جزایی ارومیه صادر گردید حال آنکه شعبه ۱۰۴ جزایی نه بازجویی های بنده و نه حتی نماینده ای از سپاه پاسداران و یا اداره اطلاعات را برای توضیح مسائل نه به بازپرسی نه به شعبه ای فرا خواند و نه با معاینه ای بنده توسط پزشک قانونی موافقت نمود حال بر چه مبنایی قرار منع تعقیب صادر کرد نمی دانم.
در کیفر خواست صادره از سوی اداره اطلاعات و هم حکم دادگاه اینجانب حسین خضری به عنوان محارب شناخته شده ام در صورتی که مصادیق محاربه نه بر بنده صادق است نه محرز اولا بنده هنگام دستگیری مسلح نبودم چون بنده فعالیت سیاسی به طور مدنی میکردم ثانیا هیچ اقدام مسلحانه ای علیه جمهوری اسلامی ایران نکرده ام همچنین بنده حدود ٨ ماه در سلول های انفرادی سپاه نبی اکرم کرمانشاه و سپاه المهدی ارومیه و اداره اطلاعات ارومیه تحت بدترین شکنجه های فیزیکی و روانی و انواع تهدید ها و تحقیرها بوده ام .
به طوری که بازداشت طولانی مدت بنده به مدت ٨ ماه در آن سلول های انفرادی چنان بر سیستم عصبی و حالات روحی و روانی ام تاثیر سو گذاشته بود که اقدام به خودکشی کردم آن هم ٢ بار! چون واقعا شکنجه ها و نوع رفتار غیر انسانی بازجویان به حدی بود که مرگ را بهتر از آن طور زندگی و زنده ماندن میدانستم و جایی بسی سوال است که در کجای دنیا فردی را ٨ ماه در سلول انفرادی مورد آزار و اذیت جسمی و روحی قرار داده اند و هیچگونه ملاقات را با وکیل یا خانواده و یا حتی تماس تلفنی با ایشان داشته باشد.
در پایان بنده زندانی سیاسی حسین خضری با توجه با آنکه تحت شدیدترین مراقبتهای امنیتی زندان قرار دارم و به طوری که حق نامه ای سر گشاده که به بالاتربن مرجع قضایی کشور نوشته ام بدون هیچگونه دلیل قانونی و خاصی از تایید اثر انگشت نامه بنده خودداری و اصل نامه نوشته شده را حفاظت زندان از بنده گرفته و باز پس نمی دهد.
حال با توجه به آشکار نبودن زمان اجرای حکم اعدام بنده که آیا فرداست یا پس فرداست از انتشار کوچکترین خبر حتی خبر سلامتی خویش به صورت راحت و آزادانه محروم می باشم لذا تحت چنین شرایط فوق سنگین امنیتی از تمامی مجامع بین المللی و سازمانهای کانون مدافع حقوق بشر و حتی افرادی که در مورد حقوق زندانیان سیاسی و همچنین در زمینه حقوق بشر فعالیت می کنند تقاضا دارم که صدای سرکوب شده مرا به گوش انواع بشریت رسانده و از هم اکنون تمامی آن مراجع و آن افراد را به عنوان وکیل رسمی خود می شناسم که هر سوالی را به نام بنده در جهت برگزاری یک دادگاه صالح و بی طرف بازبینی دوباره پرونده به طور واضح و آشکار بدون مخفی کاری، پیگیری و موضوع شکنجه وارده بر بنده را اقدام و اعمال نماید .
در پایان از شورای حقوق بشر سازمان ملل متحد؛ عفو بین الملل و تمامی مجامع حقوق بشر در خواست می نمایم با انتشار نامه اینجانب و پیگیری مسائل مطرح در آن اقدام نماید

TAKE ACTION for Hossein Khezri, Age 28, Political Prisoner at Risk of Imminent Execution in Iran

Twenty-eight year old Hossein Khezri has been under torture since end-July 2008. Orders to go forward with his execution have been received by the office of sentence implementation at Orumiyeh prison, where Khezri is being held, and his execution is believed to be imminent.
In this post you will find a short sample letter that you can use to advocate on behalf of Hossein Khezri; below that is a letter that Khezri has written describing his tortured sufferings as a political prisoner in Iran. In a final effort to avoid execution, Khezri himself has stated that, “From now on, I formally recognize all of you as my lawyers and ask you to help me take my case to a fair and just court without any secrecy, and with complete openness I will answer any and all of your questions. Finally I ask the UN Human Rights Commissioner to kindly read, publish and take on my case.” In accordance with Khezri’s request, the sample letter is targeted at the UN’s High Commissioner of Human Rights, Navi Pillay.

I am writing to you with an urgent request that you issue a demand for the Islamic Republic to immediately and unconditionally release all political prisoners in Iran, including Hossein Khezri, a 28-year-old political prisoner held in Orumiyeh prison in Iran. He has been repeatedly severely tortured, and the Islamic Republic regime has now issued orders for his immediate execution.
I fully expect the United Nations to finally take action on this and all other cases of political prisoners in Iran. People of the world do not accept the continued detentions, tortures and executions perpetrated by the Islamic Republic, and we do not tolerate the UN’s refusal to act substantively in these matters.

Condemned Prisoner Hossein Khezri Appeals to UN, HR Orgs
Hossein Khezri (also written Khazri or Khazari), a prisoner of conscience in Iran sentenced to death, writes to international Human Rights organizations:
I, Hossein Khezri, am a political prisoner accused of activities against national security by the 10th branch of the Revolutionary Court of Orumiyeh. This charge was upheld by the 10th branch of the court of appeals in Western Azerbaijan and confirmed by the 31st branch of the Supreme Court. I am sentenced to death.
I will attempt to reveal the methods used during my interrogations, the investigation and the trial; despite the court’s effort to forbid even a mention of such activities to the people of Iran and the international community, and even their refusal to acknowledge my open letter to the Justice Department. Despite all their efforts, I will attempt to report to the world some of the situation to which I am still subject, in hopes that there be someone to hear my voice.
I have been in detention since 9 Mordad 1387 (31 July 2008). I was arrested in Kermanshah by the Nabi Akram Sepah branch, and was under the authority of same for 49 days. During that time I was subject to severe physical and mental torture including the following:
1. Beatings for several hours every day;
2. Psychological pressure and intimidation during interrogation;
3. Threats to implicate my brother, brother-in-law and my family in “illegal activities” against the government;
4. Kicks to my genitals which caused bleeding and severe swelling of my genitalia for 14 days;
5. Open wound to my right leg , measuring 8 centimetres (approximately 4.5 inches) resulting from kicking by the interrogator, which is still open;
6. Severe blows to my entire body with night sticks for 49 days, causing bruising and inflammation all over my body.
Under section 38 of Iran’s constitution, torture to extract confession is strictly forbidden, and forcing a person to testify, confess or take an oath under duress is illegal, and any results obtained by such methods are considered null and void. Furthermore, the same law states that those who break this law shall be prosecuted and face punishments. Now the question is: what of this law?
As I said before, I was tortured in Kermanshah’s detention center and subject to physical and psychological pressure during the interrogation, so why is the evidence obtained under such conditions not only considered admissible in court, but is the same evidence used to sentence me so heavily?
I was transferred from Nabi Akram Sepah prison in Kermanshah to Sepah Al Mehdi of Orumiyeh on 27 Shahrivar 1387 (18 September 2008). In the new prison, I also was subjected to extreme psychological pressure and severe physical torture.
Once again I was transferred to the Information department of Orumiyeh on 16 Dey 1387 (6 January 2009) then to Western Azerbaijan’s Information Ministry headquarters on 26 Bahman 1387 (15 February 2009) and tortured again. After being transferred to the Orumiyeh prison on 21 Ordibehesht 1388 (11 May 2009), I appeared in court for the first and last time, at one of the branches of Revolutionary Court in Orumiyeh. The representative of the Information Ministry was also present at the court, along with the Orumiyeh prosecutor. Before the proceedings I was cautioned that I may not speak of torture nor am I allowed to mention any of the interrogations methods or what happened during these sessions. I was also threatened not to mention that my “confession” was obtained under torture.
Such was the atmosphere of the court, and the fact that I was not given any time to prepare a statement nor given enough time to state my case, how could my lawyer or myself be able to defend my case against such heavy accusations in less than 10 minutes even though I was innocent?
Another question is: what was the purpose of my presence in such a comedic court, if not to just prove that I had a “trial” and was ”sentenced” during the proceedings?
Despite the threats and pressures, I stated to the judge, Judge Darvishi, head of the 1st branch of the Revolutionary Court, that I was indeed tortured and the confessions are invalid since it was dictated to me while being under severe mental and physical duress. I also told him that I was cautioned not to mention the torture or retract my confessions. But alas, he proceeded with the sentencing without any attempt to investigate my claims of torture and in 10 minutes delivered the sentence of execution. The same sentence was upheld at the appeals court and on 17 Mordad 1388 (8 August 2009) was finalized and delivered to me in central Orumiyeh prison.
It is worth saying that between the first court sentencing and the appeal court, I did not stop trying, and on 5 Mordad 1388 (27 July 2009), two weeks before the final verdict, I sent a formal complaint for inhumane and illegal behavior to the attorney general of military courts in Orumiyeh, which has gone on record on 10 Dei 1388 (31 December 2009). My brother was advised on 27 Bahman 1388 (16 February 2009) that I filed a complaint against the way I was treated during interrogations by information agents in Al Mahdi prison on 16 Azar 1388 (7 December 2009) and that I wanted to have a forensic examination. My complaint at the military court was referred to the main courts, and despite my complaints about the behaviour of the interrogators and the officers of Al Mehdi branch of the Sepah, and the medical evidence of the torture that I laid before them, and my request to be sent to the Medical officer, the prosecutor of the 8th branch did not even ask to send me to the medical examiner to find out if I was telling the truth or not.
On 13 Bahman 1388 (2 February 2009), right after I sent the complaint and submitted my evidence to the medical examiner, I was taken to the Information ministry under armed guard and was kept there for three days. During these three days I was threatened about the complaint I had submitted and asked why I dared to complain, and also told that I now must appear on camera and read off the confessions they have written for me and deny that I had been mistreated in any way. I was told if I cooperate, they may lessen the charges and reduce the punishment. These naked threats to me, and their attempt to create a false reality for people, is like they are bartering with human life.
My family was terrified when they heard that I was transferred to the Information Ministry, and whenever my father attempted to find any information about me, he was given confusing and conflicting answers. He was so frightened that I may have already been executed that he suffered a fatal heart attack at the Information Ministry and was sent from there to hospital where he passed away, thus adding another chapter to the crimes of the Islamic Republic for creating such fear in the relatives of political prisoners, which is much worse than an actual execution. Who will answer for such crimes?
Not 20 days after the death of my father I was summarily exiled to prison in Qazvin [200 or so miles from Orumiyeh, his home]. You can imagine my mental condition, especially after spending hours handcuffed and blindfolded without any explanation of what is about to happen. After several hours in that condition they casually mentioned that I am to be transferred to another prison and “not to worry.” So far no one has followed up on my complaints or my request to be sent to the medical examiner. So far there has been no reason given for not following up on my complaints.
On 30 Farvardin 1388 (19 April 2009), the 104th branch of criminal court of Orumiyeh released its judgement: nobody, no official of information or representative of the revolutionary guard explained anything to me; there was no forensic medical examination and I still don’t know the basis of this sentence. An indictment based on the intelligence ministry and court made of me, Hossein Khezri, an armed combatant. I had no weapon when I was arrested, my struggle was only a political one, and I never turned any weapon against Iran. But I spent 8 months in solitary between my different cells in Nabi Akram in Kermanshah, Al Mahdi and the intelligence ministry in Orumiyeh, in the worst physical conditions, savagely tortured, humiliated and constantly threatened.
The 8 months I spent in solitary confinement affected my mental state such that I tried to kill myself twice. I thought death would be far better than this daily torture and these inhumane conditions. How is it possible in today’s world to torture someone for 8 months without allowing him to see a visitor or even contact his lawyer, not even on the phone?
In conclusion, I , Hossein Khezri, am a political prisoner sentenced to death and kept under such secrecy that when my OPEN letter arrived at the courts, the prison refused to identify my name or fingerprints, and the letter itself was confiscated. The time of my execution has not been told to me. I do not know if it will be tomorrow, or the day after, or tonight, and I am not allowed visitors and can not even let any one know that I am still alive.
It is under these conditions that I ask all human rights defenders and organizations concerned with human rights and the rights of prisoners to accept my request and be my voice to humanity.
From now on I formally recognize all of you as my lawyers and ask you to help me take my case to a fair and just court without any secrecy, and with complete openness I will answer any and all of your questions.
Finally I ask the UN Human Rights Commissioner to kindly read, publish and take on my case.

Notes: Mr. Hossein Khezri, aged 28, was detained in the city of Orumiyeh, and according to the information received on 11 April 2010, he was transferred from Orumiyeh Prison to an unknown location prior to his execution. Moreover, all of his personal belongings were taken away. On July 31, 2008, Mr. Khezri was arrested in the city of Kermanshah. On July 11, 2009 he was convicted of being a mohareb (”enemy of God”) and “endangering state security.” While in prison, he has been subjected to torture and injured so badly that his eyesight has been affected severely.
